Terms of Service
Welcome to OpsPulse. These terms of service ("Terms") govern your use of the OpsPulse monitoring service operated by OrionApps ("us", "we", or "our").
By using our service, you agree to these Terms. If you disagree with any part of these terms, you may not access the service.
1. Service Description
OpsPulse provides uptime monitoring and alerting services. We check your configured endpoints at regular intervals and notify you of incidents via your chosen notification channels (Telegram, email).
2. Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account password and for any activities or actions under your account.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
3. Subscriptions and Payments
- Some features require a paid subscription. Pricing is displayed on our pricing page.
- Payments are processed securely by Stripe.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period.
4. Free Trials
We may offer free trials. At the end of a trial, your account may be downgraded to a free plan or require payment to continue using paid features. We will not charge you without your explicit authorization.
5. Acceptable Use
You agree not to:
- Use our service for any unlawful purpose or in violation of any laws
- Monitor endpoints you do not own or have permission to monitor
- Attempt to overload, abuse, or disrupt our service or infrastructure
- Use our service to distribute spam or malicious content
- Reverse engineer or attempt to extract source code from our service
6. Service Level
We strive to maintain high availability but do not guarantee 100% uptime. We may experience temporary interruptions for maintenance or due to circumstances beyond our control.
7. Limitation of Liability
To the maximum extent permitted by law, OpsPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Our total liability for any claim arising from or relating to the service shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Data and Content
You own the data you provide to our service. We do not claim ownership of your endpoint URLs, incident logs, or configuration data.
We may retain logs for service improvement and security purposes in accordance with our Privacy Policy.
9. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination, your right to use the service will immediately cease. We may delete your account and associated data after a reasonable period.
10. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
